AI for Bars and Restaurants: Allergen, Alcohol and Labor Rules (Verify Locally)

Published · 3 min read

AI can speed up the writing and spreadsheet work in a bar or restaurant. Three areas must never rest on an AI answer: allergens, alcohol rules and labor rules. This page sets out why and where to check. It is part of the AI for Bar and Restaurant Owners hub and is general information, not legal or food-safety advice.

Caution: Allergen information must be verified by your kitchen, never from AI alone. Alcohol advertising, promotion and licensing rules vary by state and locality. Check your state and local alcohol authority, health department and labor agency.

Allergens

The FDA recognizes nine major food allergens: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans and sesame. Federal allergen labeling requirements apply to packaged foods, including foods packaged and labeled by retail and food-service establishments, but not to foods placed in a wrapper or container in response to a customer's order. The FDA advises people with allergies to ask restaurant staff about ingredients and preparation, so your team needs accurate, current answers. The FDA publishes a model Food Code that many states and localities adopt in some form; ask your health department what applies to you.

  • Build an allergen chart from real recipes and supplier labels, and have your chef or manager check it.
  • Update it whenever a recipe or supplier changes.
  • Train staff to check with the kitchen on every allergy question, not to guess.
  • Never publish allergen or dietary claims that came from AI.

Alcohol

Federal advertising rules under the Federal Alcohol Administration Act apply to alcohol advertising in or calculated to induce interstate or foreign commerce, and the regulations for distilled spirits do not apply to a retailer unless it also acts as a distiller, importer, wholesaler or similar (see TTB's page on the advertising provision). TTB also says that each state regulates the production, sale and distribution of alcohol within its borders and that state and local requirements can be stricter than federal ones (see its state authority list). Examples of what states do regulate: on-premises advertising, price advertising and what an ad may show or encourage. Check your state alcohol agency before running promotions, and never use AI to find ways around age or licensing rules.

Labor and scheduling

Wage, hour, break and minor-employment rules and local scheduling laws differ by place. Use AI to draft a schedule, then check it against the rules that apply to you through your state labor department or an HR adviser.

Guest and staff privacy

Keep guest names, contact details and reservation or payment data, and staff personal information, out of general AI tools. Use placeholders.

Frequently asked questions

Which allergens do I have to know?

The nine US major food allergens are milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans and sesame. Your local food code may add requirements, so check with your health department.

Can I use AI to tell a guest what is in a dish?

No. Guests with allergies need an answer from someone who has checked the actual recipe and ingredients that day.

Do federal alcohol advertising rules apply to my bar?

The federal regulations mainly target producers, importers and wholesalers and generally exempt retailers unless they also operate in those roles, but state and local rules still apply. Check with your state alcohol authority.

Where do I check state alcohol rules?

Start with your state alcohol beverage control or licensing agency. TTB maintains a list of state alcohol authorities.
